Harvesting Vegetables (Broccoli and Cabbage): Workers will manually harvest broccoli and cabbage at assigned locations under direct supervision. They will move down assigned rows, check if vegetables are ready for harvest, and cut or pick them using hand tools such as harvest knives. Harvested vegetables are placed into field containers, and when a container is full, workers carry it to the harvesting truck and empty it. This process is repetitive and physically demanding. Workers will receive instruction and guidance from supervisors on how to perform the tasks. Potato Harvesting: Workers will manually gather potatoes from the ground following a mechanical digger. Potatoes are placed into 5/8 bushel buckets, which are then carried to the field truck and emptied. This work involves bending, lifting, and carrying repeatedly throughout the shift. General Maintenance and Other Farm Tasks: During periods when harvesting is not available, such as inclement weather, reduced harvest activity, or for workers with physical work restrictions, workers may perform general maintenance and other farm tasks under supervision. Duties include clearing debris, weeds, and invasive vines; removing plastic mulch or ground covers; pruning, sprouting, or painting trees for sun protection; assisting with minor irrigation repairs; and performing general cleaning or minor, incidental repairs to farm structures and worker housing. The worker must be able to work outside for at least 6 hours a day in all kinds of weather (including heat, cold, and light rain) and be in possession of the requisite physical strength and endurance to work quickly and skillfully with their hands repeatedly at a sustained pace to meet the production standards demonstrated by the supervisor. The employer will provide all necessary tools and equipment at no charge to the worker. However, the employer may deduct the reasonable cost of damages or replacement of such tools if the loss or repair results from the worker's willful neglect or gross negligence; such deductions will only occur after the damage has taken place and after obtaining the employee's written authorization. At its sole discretion, the employer may pay a higher wage rate than the stated AEWR to any worker based on individual performance, specialized experience, or tenure with the operation. This voluntary higher pay is intended to reward performance and does not alter the fundamental entry-level nature of the job requirements. Employees may volunteer to work additional hours when work is available. While available hours may occasionally exceed the hours offered, such additional hours are not guaranteed. Workers are not required to work beyond the daily or weekly hours stated in the contract, nor on a worker’s Sabbath or federal holidays. Workers should expect occasional periods of little or no work due to weather, crop maturity, or other conditions beyond the employer’s control. These periods may occur at any time throughout the season. If a worker requests a leave of absence during the contract period while work is available, the hours missed during that leave will be deducted from hours worked but still counted toward the total hours offered under the ETA-790 for purposes of meeting the three-quarter guarantee. A copy of the work contract, or ETA Form 790 in lieu of a separate contract, including any approved modifications, will be provided in the language the worker understands. For H-2A workers, the contract will be provided no later than the time of visa application. For workers in corresponding employment, the contract will be provided no later than the first day of work. For H-2A workers transferring to a subsequent H-2A employer, the contract will be provided no later than the time the subsequent offer of employment is made.
