Sorting/Grading potatoes: Potatoes will be harvested by machine and put in a conveyor belt; workers will stand by the conveyor belt and sort the potatoes by size and quality at the same time workers will need to remove debris. Potatoes packing: Trucks will take the harvested potatoes to the packing house which is located inside the farm, workers will pick out the potatoes that will be used for seed the rest of the potatoes will be separated by size, labeled and packed. Note: The packing house is located inside the Farm and more than 50% of the product processed is produced by the Fixed Site Employer. Workers who qualify may occasionally help with moving trucks and using forklifts inside the farm. General Maintenance: Workers on physical work restrictions or when harvesting work is not available may be required to perform miscellaneous clean-up work on work site property, on structures utilized in the work site operation, and on housing for harvesting workers. Such clean-up activities include the sprouting, pruning, and painting of trees; debris, weed, and vine removal; irrigation repair; housing and structure cleaning and repair. Workers must be able to perform strenuous manual labor outdoors in all weather conditions, including extreme heat, cold, and rain, for a minimum of six (6) hours per day. The position requires physical strength and endurance to bend, stoop, and stand for extended periods, as well as manual dexterity to repetitively use hands in a fast-paced agricultural environment. Lifting up to 50 lbs is required but does not involve specialized skill or training. The employer will provide all tools, supplies, and equipment required (if applicable) to perform assigned duties at no cost to the worker. Consistent with applicable law, the employer may recover the reasonable cost of repair or replacement of tools or equipment if loss or damage results from the worker’s willful misconduct or gross negligence. Any such recovery will occur only after the damage has occurred, upon receipt of the worker’s voluntary written authorization, and provided such recovery does not violate applicable wage law. Employees may volunteer to work additional hours when work is available. While available hours may occasionally exceed the hours offered, such additional hours are not guaranteed. Workers are not required to work beyond the daily or weekly hours stated in the contract, nor on a worker’s Sabbath or federal holidays. Workers should expect occasional periods of little or no work due to weather, crop maturity, or other conditions beyond the employer’s control. These periods may occur at any time throughout the season. If a worker requests a leave of absence during the contract period while work is available, the hours missed during that leave will be deducted from hours worked but still counted toward the total hours offered under the ETA-790 for purposes of meeting the three-quarter guarantee. A copy of the work contract, or ETA Form 790 in lieu of a separate contract, including any approved modifications, will be provided in the language the worker understands. For H-2A workers, the contract will be provided no later than the time of visa application. For workers in corresponding employment, the contract will be provided no later than the first day of work. For H-2A workers transferring to a subsequent H-2A employer, the contract will be provided no later than the time the subsequent offer of employment is made.
